SHARE A SMILE SELFIE WITH LAY’S® CONTEST (the “Contest”)
OFFICIAL RULES (the “Rules”)


This Contest is intended for viewing and participation in Canada only and shall be interpreted according to the laws of Canada. Participants must be legal residents of Canada who are at least the age of majority in their province or territory of residence at the time of entry.

1. SPONSOR: The sponsor of this Contest is PepsiCo Canada ULC (the “Contest Sponsor”). The Contest is being administered on behalf of the Contest Sponsor by Majestic Media (the “ Administrator”).

2. ELIGIBILITY: The Contest is open to legal residents of Canada, who are at least age of majority in their province or territory of residence at the time of entry. The Contest is not open to employees of the Contest Sponsor, the Administrator, and each of their respective parents, subsidiaries, affiliates and related companies, representatives, agents, advertising or promotion agencies, contest prize suppliers, any other companies engaged in the development, production or distribution of materials for this Contest, and members of their immediate families (defined as spouse, parent, child, sibling, grandparent, regardless of where they live), or persons domiciled with (whether related or not) any of the above.

3. Contest Period: The Contest begins at 12:00 pm (noon) Eastern Time (ET) on February 27, 2017 and ends at 11:59:59 pm (ET) on April 22, 2017 (the “Contest Period”).

4. How to Enter: Visit www.lays.ca/smile (the “ Contest Page”) and follow the instructions to complete the initial registration by using either your Facebook account, Twitter account or by email. If you register by email, you will need to provide your first name, last name, province or territory and email address. By registering for the contest, you confirm that you are at least the age of majority in your province or territory of residence and you agree to participate according to these Rules. Once you have completed the above, click “register” to begin. By registering for the Contest by any of the above methods, you will receive twenty-five (25) entries into the Contest for the remaining Daily Prize Draws, Weekly Prize Draws, and Grand Prize Draw.

To receive additional entries into the Contest, follow the instructions on screen and use your desktop or mobile phone to upload a Smile selfie image (i.e., a photograph of your face) to the Contest Page, and apply one of the six (6) fun flavour filters available. Subject to verification with the Submission Guidelines outlined in Rule 5 below, for each Smile selfie uploaded with a unique fun flavour filter, you will receive fifty (50) entries into the remaining Daily Prize Draws, Weekly Prize Draws and Grand Prize draw. Maximum of three hundred (300) fun flavour filter entries, fifty (50) per unique fun flavour filter.

There is a limit of three hundred and twenty five (325) Contest entries per individual during the Contest Period, excluding Bonus Entries as outlined in Rule 6 below. Only one (1) account may be used by any person to participate in the Contest. Duplication or any attempts or suspected attempts, as determined in the sole discretion of the Contest Sponsor, to exceed the maximum number of entries or accounts per person or per email address is a violation of these Rules and may result in disqualification and forfeiting of any prize. Entrant must not create false identities, or impersonate any person or entity, or falsely state or otherwise misrepresent an affiliation with any person or entity.

The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server(s). Automated, scripted or robotic entries are prohibited, and any use of such automated devices may result in disqualification. Proof of submission does not constitute proof of receipt.

For any method of entry, in the event of a dispute over the identity of an entrant, the entry will be considered made by the Registered Owner (as defined in below) of the applicable account. “ Registered Owner” is defined as the natural person who is assigned to an account by the organization/individual that is responsible for assigning accounts for the applicable platform.

NO PURCHASE NECESSARY. Although online access and an email account are required in order to participate in the Contest, no purchase is required. Many public libraries, Internet cafés, retail businesses and others offer access to the Internet and a number of Internet service providers and other companies offer free email accounts.

5. PHOTOGRAPH SUBMISSION AND POSTING GUIDELINES (“Submission Guidelines”):

Any photo uploaded by an entrant must:

A. Be an original work, created solely by the entrant, and over which the entrant has all necessary rights, title and interest, including copyright;

B. Not infringe upon the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased;

C. Not use, or be confusingly similar to, the brand names, trade names, trademarks or logos of any third parties;

D. Not contain or make any reference to any branded food or beverage products other than LAY’S potato chips;

E. Be suitable for family audiences, in the sole determination of the Contest Sponsor. Without limitation, entries and usernames shall not contain any content that is or contains: the promotion of unlawful behaviour, political in nature, profanity, nudity, explicit sexuality, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or is hatefully, racially, ethnically or otherwise offensive or objectionable;

F. Comply with the Terms of Use and other contracts and policies governing the Facebook platform ( https://www.facebook.com/legal/terms ) or Twitter platform (available at https://twitter.com/tos?lang=en );

G. Have been created specifically for this Contest, and have not been previously published, or entered into, or received any awards in, any other contest or competition;

H. Be from an identifiable source. The entrant must not create a false identity, or impersonate any person or entity, or falsely state or otherwise misrepresent an affiliation with any person or entity;

I. Not be prohibited for use by applicable laws or guidelines;

J. Be consistent with the Contest Sponsor’s image; and

K. Comply with these Rules.

The Contest Sponsor reserves the right to review any entry at any time during the Contest Period for compliance with these Submission Guidelines and these Rules and to take such action as it deems appropriate, including removing any entry or entrant from the Contest in the Contest Sponsor’s sole discretion. Any such review shall not relieve entrants from responsibility for compliance with these Rules.

By entering, you: (i) represent and warrant that you have the right and authority to, and do hereby, grant to the Contest Sponsor an irrevocable, non-exclusive, royalty-free worldwide license in perpetuity to produce, reproduce, encode, store, copy, transmit, broadcast, display, distribute, use, edit, translate, alter, combine with other material, reuse, exhibit, publish, post, adapt, create derivative works from, commercialize, trademark, copyright and or otherwise use without limitation all or any part of the entry in any manner and media whether now known or hereafter devised including, without limitation, on social media platforms and product packaging; and (ii) waive any and all moral rights that you may have in and to the entry with respect to the uses contemplated herein.

By entering the Contest, entrants agree to release and hold harmless the Contest Group (as defined below) from any and all claims that any commercial, advertising, presentation, web content or other material in any media throughout the universe subsequently produced, presented and/or prepared by or on behalf of the Contest Sponsor, infringes with regard to any elements, characters or ideas contained in your entry. For greater certainty, the Contest Sponsor will not be responsible should any future packaging, advertising, promotion, or other independently developed creative, marketing or advertising materials bear any resemblance to an entry that is not declared to be a winning entry.

By submitting an entry, you warrant and represent that it: (i) is your original work, created solely by you, and over which you have all necessary rights, title and interest, including copyright (excluding content provided by the Contest Sponsor, if applicable); (ii) does not infringe upon the intellectual property rights, or defame or invade the publicity or privacy rights, of any third party, living or deceased; and (iii) that publication of the entry via various media, including without limitation publicly on the Internet, will not infringe on the rights of any third party. Entrant agrees to defend, indemnify and hold harmless the Contest Group from any claims involving a breach of the warranties and representations in this Rule 5.

6. BONUS ENTRIES: After submitting your entry into the Contest, you will have an opportunity to earn Bonus Entries (as defined below) as follows:

(i) Invite Friends to Enter via Facebook: Click on the Facebook “Invite” button after submitting your entry into the Contest as outlined in Rule 4 and follow the instructions to invite your friend(s) to enter the Contest (“Facebook Method”). You will NOT receive any Bonus Entries for the act of sending an invitation; however, you will earn fifty (50) Bonus Entries into the remaining Daily Prize Draws, Weekly Prize Draws, and Grand Prize Draw for each friend (to a maximum of five (5) friends) who accepts your invitation by clicking on the shared link, successfully enters the Contest in accordance with these Rules, including, without limitation, by satisfying the eligibility requirements set out in Rule 2 above, and by submitting an entry as described in Rule 4 above. There is a limit of up to two hundred and fifty (250) Bonus Entries via the Facebook Method for the duration of the Contest. You cannot invite the same friend more than once during the Contest Period. You may only invite people: (i) with whom you are friends (i.e. with whom you have had direct, voluntary, two-way communications, and with whom it is reasonable to believe there exists a personal relationship, considering relevant factors such as shared interests, experiences, and frequency of communication) or who are members of your family (i.e. with whom you are related by marriage, a common-law partnership, or parent-child relationship, and with whom you have had direct, voluntary, two-way communications); and (ii) by whom the invitation from you would not be considered spam or otherwise offensive. Ensure you have your friends’ permission before sending an invitation.

(ii) Share the Contest on Twitter: Click on the Twitter "Tweet" button after submitting your entry into the Contest as outlined in Rule 4 and follow the instructions to invite your Twitter followers to enter the Contest (“Twitter Method”). You will receive fifty (50) Bonus Entries when you click the Twitter “Tweet” button and successfully share the Contest on Twitter. There is a limit of fifty (50) Bonus Entries using the Twitter Method for the duration of the Contest.

(iii) Watch a Video: Receive fifty (50) Bonus Entries for watching the YouTube video to completion. There is a limit of fifty (50) Bonus Entries for watching the video for the duration of the Contest. Note: the Bonus Entry video will not be released until March 6, 2017 at 12:00 pm ET.

Bonus entries accumulated through the methods provided above are collectively “Bonus Entries” and each a “ Bonus Entry”. To be eligible for any draw, Bonus Entries must be submitted and received within the Contest Period as provided in these Rules.

7. PRIZES AND DRAWS:

(i) DAILY PRIZES AND DAILY PRIZE DRAWS. There are a total of five hundred and forty (540) daily prizes available to be won, and ten (10) to be awarded each Day (as defined herein), excluding February 27, during the Contest Period. Each daily prize consists of a $25 Cineplex gift card (the “Daily Prize”). Gift card subject to the terms and conditions listed on the card.

Ten (10) Daily Prizes are available to be won each day during the Contest Period. The total number of Daily Prizes available to be won will diminish each day throughout the Contest Period. Limit one (1) Daily Prize per person or household during the Contest. Please allow 4 – 6 weeks following verification for delivery of Daily Prize.

For each Day of the Contest Period, a random draw (each, a “ Daily Prize Draw”) will be conducted from among all eligible entries received in the Contest to select ten (10) entries as eligible to win a Daily Prize described above. In these Rules, a “ Day” is defined as a 24-hour period beginning at 12:00 am ET (i.e. midnight), except February 27 (day 1) which begins at 12:00 pm (noon) ET.

Each Daily Prize Draw will take place on the next business day following entry at approximately 2:00 pm ET at 20 Bay Street, 11th Floor, Toronto, ON. The odds of winning a Daily Prize depend on the total number of eligible entries (including any Bonus Entries) received each Day during the Contest Period. In the event that there are no entries received for any Daily Prize during the Contest Period, that Daily Prize Draw will not be conducted and that Daily Prize will not be awarded.

NOTE: Entries or Bonus Entries received in any given Day are carried forward and are eligible for consideration for all remaining draws.

(ii) WEEKLY PRIZES AND WEEKLY PRIZE DRAWS. There are a total of eight (8) weekly prizes available to be won, each consisting of one (1) GoPro HD Waterproof Camera (the “Weekly Prize”). Approximate retail value $340 each.

One (1) Weekly Prize is available to be won each Week in the Contest Period as provided in the chart below. The number of Weekly Prizes available to be won will diminish each week throughout the Contest Period. Limit one (1) Weekly Prize per person or household during the Contest. Please allow 4 – 6 weeks following verification for delivery of Weekly Prize.

For each Week of the Contest Period, a random draw (each, a “ Weekly Prize Draw”) will be conducted from among all eligible entries received. One (1) entry will be selected for each Week in the Contest Period as eligible to win a Weekly Prize described above.

Each Weekly Prize Draw will take place as provided in the chart above at approximately 2:00 pm ET at 20 Bay Street, 11th Floor, Toronto, ON. The odds of winning a Weekly Prize depend on the total number of eligible entries (including any Bonus Entries) received each Week during the Contest Period. In the event that there are no entries received for any Weekly Prize during the Contest Period, that Weekly Prize Draw will not be conducted and that Weekly Prize will not be awarded.

(iii) GRAND PRIZE AND GRAND PRIZE DRAW: There is one (1) grand prize available to be won during the Contest Period. The selected Grand Prize winner will have the choice between one (1) of four (4) grand prize choices. Once confirmed as a winner, the selected entrant will be able to choose one (1) of the following grand prize packages (each individually referred to as the “Grand Prize”). Approximate retail value $10,000 CAD.

Choice #1:

A trip for four (4) to Vancouver and Whistler, British Columbia, consisting of:

  • Round trip economy class air transportation for four (4) from the major international airport closest to winner’s place of residence in Canada to Vancouver, British Columbia
  • Three (3) nights double occupancy hotel accommodation in Vancouver
  • Two (2) nights double occupancy hotel accommodation in Whistler
  • Spending money in the amount of the difference between $10,000 CAD and the actual cost of the air transportation and accommodations for winner only

  • Five (5) nights double occupancy hotel accommodation
  • Spending money in the amount of the difference between $10,000 CAD and the actual cost of the air transportation and accommodations for winner only

Choice #4:

A trip for four (4) to Montreal and Quebec City, Quebec, consisting of:

  • Round trip economy class air transportation for four (4) from the major international airport closest to winner’s place of residence in Canada to Montreal, Quebec
  • Three (3) nights double occupancy hotel accommodation in Montreal
  • Two (2) nights double occupancy hotel accommodation in Quebec City
  • Spending money in the amount of the difference between $10,000 CAD and the actual cost of the air transportation and accommodations for winner only

The approximate retail value of Choice #4 is $10,000 CAD which is based on a sample departure from Vancouver, BC. Actual value may vary depending on winner’s point of departure and air fare.

GENERAL GRAND PRIZE CONDITIONS: The Grand Prize must be accepted as awarded and cannot be substituted, transferred, exchanged or surrendered for cash, except at the sole and absolute discretion of the Contest Sponsor, which may award a substitute prize of equal or greater value.

Difference between approximate retail value and actual retail value, if any, will not be awarded. The Grand Prize winner and his/her guests are responsible for all other expenses not specifically mentioned herein, including, without limitation, ground transportation, meals, gratuities, taxes, travel documents, telephone calls, in-room movies, mini-bar expenses, room service, medical and travel insurance, excess baggage costs, optional tours, airport departure taxes, duties, all personal expenses and all other expenses not specified herein. The Grand Prize winner’s guests must be legal residents of Canada and minor guests must be accompanied by a parent or legal guardian. The Grand Prize winner and his/her guests must travel together. Transportation, and accommodations are subject to availability, standard industry blackout periods (such as December 25, 26, 31; January 1; Spring break, etc.), government restrictions and regulations, hotel, airline, airport or other transportation restrictions and regulations. Other restrictions may apply. The Grand Prize winner and his/her guests are responsible for obtaining all required medical and travel related necessities (including vaccinations) and documentation, including a valid passport. If the Grand Prize winner does not have proper travel documentation, or does not accept or participate in any portion of the Grand Prize for any reason whatsoever (including reasons beyond the control of the Grand Prize winner such as inclement weather delaying or cancelling a portion of the trip), the Grand Prize winner forfeits that portion of the Grand Prize, and the Contest Sponsor shall have no further obligation or liability to Grand Prize winner with respect to the forfeited portion of the Grand Prize. It is recommended that the Grand Prize winner and his/her guests obtain sufficient personal travel insurance (including emergency medical) prior to departure. The Grand Prize winner and his/her guests are responsible for transportation to and from the departure airport. The Contest Sponsor is not liable if travel is impeded or refused by reason of decisions of any governmental authorities (foreign or domestic), or other airline or airport authorities. The Grand Prize winner and his/her guests must sign and return the Contest Sponsor’s form of declaration of compliance and release prior to ticketing. No responsibility is assumed by the Contest Sponsor if any part of Grand Prize selected (or element(s) thereof) is cancelled, delayed, suspended or rescheduled after ticketing of the Grand Prize for any reason whatsoever beyond its control.

The Grand Prize winner acknowledges that the Contest Group (as defined below) have not made or are not in any manner responsible or liable for any warranty, condition, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. The Contest Group shall not be liable for injury, loss, or damage of any kind, including death, resulting from the acceptance or use/misuse of the Grand Prize, travel related thereto or otherwise from participation in the Contest.

On April 25, 2017, following the last Weekly Prize Draw, at 20 Bay Street, 11th Floor, Toronto, ON, one (1) entry will be randomly drawn from among all eligible entries received during the Contest Period for the Grand Prize (the “Grand Prize Draw ”). The odds of winning the Grand Prize depend on the total number of eligible entries received during the Contest Period.

8. HOW TO CLAIM A PRIZE:

(i) DAILY PRIZE: If you are selected as eligible to win a Daily Prize, you will be notified by email within three (3) business days following the draw (the “Daily Prize Notification”). In order to be declared a winner, a potential winner must: (i) respond to correspondence from the Contest Sponsor’s designated agent and complete the documentation outlined below within five (5) business days of Daily Prize Notification; (ii) correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a required mathematical skill-testing question; (iii) if requested by the Contest Sponsor, sign a form of prize claim form and release of liability releasing the Contest Group from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of any prize or any portion thereof and return to the Contest Sponsor’s designated agent by fax or email within five (5) business days of receipt of the prize claim form and release of liability; and (iv) otherwise comply with these Rules. If a potential Daily Prize winner fails to meet any of these requirements, he/she may be disqualified and forfeit the Daily Prize. The Contest Sponsor may then, at its sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsor or its representatives will attempt to contact, and who will be subject to disqualification in the same manner. The Contest Sponsor will not be responsible for failed attempts to notify any potential Daily Prize winner.

No responsibility is assumed by the Contest Sponsor for prizes after they have been shipped, and each winner bears all risk of loss or damages to his/her prize after shipping. The Contest Sponsor makes no representations, warranties or conditions of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damages to prizes after delivery. Unclaimed prizes will not be awarded.

(ii) WEEKLY PRIZE: If you are selected as eligible to win a Weekly Prize, you will be notified by email within three (3) business days following the draw (the “Weekly Prize Notification”). In order to be declared a winner, a potential winner must: (i) respond to correspondence from the Contest Sponsor’s designated agent and complete the documentation outlined below within five (5) business days of Weekly Prize Notification; (ii) correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a required mathematical skill-testing question; (iii) if requested by the Contest Sponsor, sign a form of declaration of compliance and release of liability releasing the Contest Group from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of any prize or any portion thereof and return to the Contest Sponsor’s designated agent by fax or email within five (5) business days of receipt of the declaration of compliance and release of liability; and (iv) otherwise comply with these Rules. If a potential Weekly Prize winner fails to meet any of these requirements, he/she may be disqualified and forfeit the Weekly Prize. The Contest Sponsor may then, at its sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsor or its representatives will attempt to contact, and who will be subject to disqualification in the same manner. The Contest Sponsor will not be responsible for failed attempts to notify any potential Weekly Prize winner.

No responsibility is assumed by the Contest Sponsor for prizes after they have been shipped, and each winner bears all risk of loss or damages to his/her prize after shipping. The Contest Sponsor makes no representations, warranties or conditions of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damages to prizes after delivery. Unclaimed prizes will not be awarded.

(iii) GRAND PRIZE: If you are selected as eligible to win the Grand Prize, you will be notified by email within three (3) business days following the draw (the “Grand Prize Notification”). In order to be declared a winner, a potential winner must: (i) respond to correspondence from the Contest Sponsor’s designated agent and complete the documentation outlined below within five (5) business days of Contest Sponsor’s Grand Prize Notification; (ii) correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a required time-limited mathematical skill-testing question to be administered by the Contest Sponsor’s designated agent at a mutually agreeable time; (iii) sign a form of declaration of compliance and release of liability releasing the Contest Group from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of any prize or any portion thereof and return to the Contest Sponsor’s designated agent by fax or email within five (5) business days of receipt of the declaration of compliance and release of liability; and (iv) otherwise comply with these Rules. If a potential winner fails to meet any of these requirements, he/she will be disqualified and forfeit the Grand Prize. The Contest Sponsor may then, at its sole and absolute discretion, select by random draw another eligible entrant whom the Contest Sponsor or its representatives will attempt to contact, and who will be subject to disqualification in the same manner. The potential winner may be required to furnish proof of identification that may include a driver’s license or other form of photo identification as part of the verification process. The Contest Sponsor will not be responsible for failed attempts to notify any potential Grand Prize winner.

No responsibility is assumed by the Contest Sponsor for prizes after they have been shipped, and each winner bears all risk of loss or damages to his/her prize after shipping. The Contest Sponsor makes no representations, warranties or conditions of any kind concerning the appearance, safety or performance of any prize. Winner bears all risk of loss or damages to prizes after delivery. Unclaimed prizes will not be awarded.

9. ADDITIONAL CONDITIONS OF PARTICIPATION: By participating in this Contest, each entrant accepts and agrees to these Rules and all decisions of the Contest Sponsor, which shall be final and legally binding on the entrant in all matters relating to this Contest including, without limitation, eligibility and/or disqualification of entries. All entries become the property of the Contest Sponsor and will not be acknowledged or returned. No responsibility is assumed by the Contest Group for any inability for a potential entrant to successfully enter any draw for any reason. The Contest Group is not responsible for late, lost, damaged, misdirected, mutilated, garbled, illegible or incomplete entries. Proof of transmission (e.g. screenshots) does not constitute proof of receipt by the Contest Sponsor. By submitting an entry to this Contest, entrants confirm their compliance with these Rules, and release the Contest Sponsor, the Administrator, the prize suppliers, and each of their respective subsidiaries, parents and affiliates, and each of their respective shareholders, employees, directors, officers, representatives, agents, successors and assigns (collectively, the “ Contest Group”) from all liability or responsibility for any claim arising in connection with entrant’s acceptance, use or misuse of the prize or otherwise from such entrant’s participation in this Contest. By entering this Contest, each entrant and winner acknowledges and agrees that the Contest Group disclaims any implied warranty.

10. DISPUTES:

(a) residents of quebec: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Any applicable decision to be made by the Contest Sponsor affecting the conduct of this Contest are subject to a ruling of the Régie des alcools, des courses et des jeux.

(b) RESIDENTS OF CANADA, EXCLUDING QUEBEC: All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

11. Any attempt by an entrant or other individual to deliberately damage any website or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Participants engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.

12. Entries generated (or suspected to have been generated) by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified.

13. The Contest Sponsor may, at its sole discretion and without liability, terminate the Contest in whole or in part, without notice, or modify or suspend the Contest at any time, subject to the approval of the Régie des alcools, des courses et des jeux with respect to the province of Quebec, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or communications or any other errors or other causes beyond the control of the Contest Sponsor corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by these Rules. In no event will the number of prizes awarded exceed the available number of prizes as specified in these Rules.

14. The Contest Group is not responsible for (and reserves the right, in its sole discretion, to correct) typographical or other errors in the offer or administration of this Contest, including but not limited to, errors in advertising, the Rules, the selection and announcement of winners, distribution of the prizes or technical malfunctions of telephone network lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any email to be received by the Contest Sponsor or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof. The Contest Group is not responsible for damage to a user’s system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest. The Contest Group does not warrant that access to or use of the Contest will be uninterrupted or error-free.

15. This Contest is subject to all applicable federal, provincial, territorial and municipal laws. Void where prohibited.

16. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and the Contest Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario. The Contest Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision of the Rules is determined to be invalid or otherwise unenforceable, then the Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

17. In the event of any discrepancy or inconsistency between the terms and conditions of these English language Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the declaration of compliance and release of liability, and/or point of sale, print or online advertising; the terms and conditions of these English language Rules shall prevail, govern and control.

18. PERSONAL INFORMATION AND PUBLICITY RIGHTS: Unless entrants otherwise indicate, the personal information collected, used and disclosed by the Contest Sponsor about entrants in the course of this Contest will be used by the Contest Sponsor for the administration of the Contest and prize fulfillment. The Contest Page is hosted on servers in the United States, and the personal information you provide may therefore also be subject to the laws of the United States. By participating in this Contest or accepting a prize, you agree to the Contest Sponsor's use of your name, city/province/territory of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity the Contest Sponsor may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice.
